Nationwide took me to court before the lockdown. A law charity rep sat in on the hearing unbeknownst to me.
This lawyer told me later that the possession application was not validly signed. A paralegal from TLT LLP Bristol had signed the statement of truth and charge £600 to do so, but this does not satisfy the companies act 2006 section 44, signing of documents.
The county court should not of accepted their application.
The reason the Building Society wouldn’t sign it i believe is, they have sold the mortgage deed and no longer have a vested interest in the property, they are merely the administrators of the account for someone or thing who they don’t know themselves.
They are taking me to court again now lock down is over. I wonder who will sign the possession application this time?.
